1. INTRODUCTION
These Terms of Use (&ldquo;Terms of Use,&rdquo; &ldquo;Terms,&rdquo; or &ldquo;Agreement&rdquo;) govern your use of the website located at&nbsp; https://www.AgentMatch.ai/ and any other websites, AgentMatch mobile application (the &ldquo;App&rdquo;), and platforms operated by AgentMatch.AI, Corp., a California corporation (collectively, &ldquo;AgentMatch,&rdquo; &ldquo;we,&rdquo; &ldquo;us,&rdquo; or &ldquo;our&rdquo;) that link to these Terms of Use (collectively, the &ldquo;Sites&rdquo;), and the related content, platforms, services, products, and other functionality offered on or through our services (collectively, the &ldquo;Services&rdquo;). These Terms apply to all online visitors to any Services, whether or not you obtain a paid Membership or Subscription (defined in Section 2).&nbsp; PLEASE READ THESE TERMS CAREFULLY, AS THEY CONSTITUTE A LEGAL AND BINDING AGREEMENT BETWEEN YOU AND AGENTMATCH.
AgentMatch is operated in compliance with all state and federal housing laws.
By visiting, viewing, or using any of our Sites, creating an Account, creating a Profile, or obtaining a Membership or Subscription, you (&ldquo;you,&rdquo; &ldquo;your,&rdquo; or &ldquo;User&rdquo;) confirm your agreement to be bound by these Terms, including the information set forth in our privacy policy, located at www.agentmatch.ai (the &ldquo;Privacy Policy&rdquo;).&nbsp; Further, you expressly represent that you are legally competent and of legal age to enter into this agreement and agree to be bound by these Terms. We reserve the right to make any changes in our sole discretion, from time to time, to these Terms of Use and our Privacy Policy or any other applicable company policies (collectively, the &ldquo;Company Policies&rdquo;) (which are hereby incorporated herein by reference) as well as modify the prices charged for our services without prior notification to you. It is your responsibility to review these Terms and any Company Policies periodically. If we make changes to these Terms or any of the Company Policies, and you continue to use our Sites, or maintain a Membership or Subscription with us, you are agreeing to the Terms expressed herein and our Company Policies. If you do not agree to these outlined Terms, your only recourse is to discontinue use of all Sites and Services operated by AgentMatch and cancel any current Membership or Subscription or refrain from obtaining a Membership or Subscription.&nbsp; If you do not agree to be bound by these Terms, you may not use any Sites, Services or obtain a Membership or Subscription.
If your use of any of our Sites or Services or your Membership or Subscription is terminated for any reason, then: (a) these Terms shall survive such termination and will continue to apply and be binding upon you with respect to your prior use of the Sites, Services, or Membership or Subscription (and any unauthorized further use of the Membership or Subscription), including, without limitation, your indemnification obligations; and (b) any rights or licenses granted to us under these Terms will survive such termination.
IMPORTANT: PLEASE REVIEW THE ARBITRATION CLAUSE SET FORTH BELOW CAREFULLY, AS IT WILL REQUIRE YOU TO RESOLVE DISPUTES WITH AGENTMATCH ON AN INDIVIDUAL BASIS THROUGH FINAL AND BINDING ARBITRATION. BY ENTERING INTO THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND HAVE TAKEN TIME TO CONSIDER THE CONSEQUENCES OF THIS IMPORTANT DECISION. 
2. CREATING AND ACCESSING YOUR ACCOUNT/PRIVACY POLICY
While you may view, access, and/or use some of the functionality of any Sites without registration, specific tools and certain services on the Sites require creating an account (the &ldquo;Account&rdquo;), and your submission and/or verification of certain information, including credit card information to set up a [membership (the &ldquo;Membership&rdquo;) or Subscription (the &ldquo;Subscription&rdquo;)]. You agree that you will not create more than one Account or create an Account for anyone other than yourself without first receiving permission from the other person. In exchange for your use of any Sites, you agree to provide accurate, current, and complete information when and as required for accessing and/or using any Sites or obtaining Membership or a Subscription or creating an Account. If you provide any information that is untrue, inaccurate, not current, incomplete, or misleading, or if AgentMatch has reasonable grounds to suspect that such information is untrue, inaccurate, not current, incomplete, or misleading, AgentMatch reserves the right to terminate your Account immediately and suspend your use of any Sites.
Your Account is accessible by anyone with your username and password. If someone obtains unauthorized access to your Account, they could contact other users or take other actions through your Account, and AgentMatch&rsquo;s ability to respond may be limited. You shall at all times remain responsible for maintaining the confidentiality of any Account, or Membership or Subscription, username, password, and any other related security information. AgentMatch.AI may send you a notice relating to account security, such as informing you that you may have recently interacted with a compromised account. AgentMatch cannot, does not, and will not guarantee that such notice will always be sent or received, and you therefore agree that AgentMatch bears no responsibility for doing so. Further, AgentMatch will not be liable for any loss under any circumstances whatsoever that you may incur as a result of someone else accessing or using your Account, either with or without your knowledge.
Our Privacy Policy explains how your personally identifiable information and other relevant information is collected, used, and/or disclosed.&nbsp; You agree to be bound by the terms of our Privacy Policy which can be found at the following link: www.agentmatch.ai. We respect your privacy and will use information provided by you only in accordance with these Terms and the Privacy Policy.
3. PROPERTY LISTINGS
The Sites serves as a virtual venue for real estate professionals to post property listings and related information. However, we do not guarantee the accuracy, completeness, or legality of any property listings or any content provided by real estate professionals.
By using the Sites, you acknowledge and agree that we are not responsible for any errors, inaccuracies, or omissions in property listings or related information. Furthermore, we have no involvement whatsoever in the real estate transaction process between Users and any third party, including real estate professionals and property buyers. We disclaim in every way any liability for any issues or disputes arising from or related to any property listings, including but not limited to property details, history, description, location, availability, pricing, or suitability. Users are encouraged to independently verify the information and conduct their own research before making any decisions based on the property listings or other content provided.
The availability of properties is subject to change and is not controlled by us. Property listings may be withdrawn, expire, or the listing status may change between the time you view the property listing and the time you connect with the appropriate real estate professional. While we make efforts to maintain the accuracy and keep information up to date, we shall have no responsibility whatsoever for withdrawn or expired property listings, or changes to a property listing&rsquo;s status. Furthermore, we do not guarantee the outcome of any negotiations or transactions in connection with any property listing. You acknowledge that any information provided regarding property availability on our Sites is for informational purposes only and may not reflect current or accurate status. AgentMatch may store a property listing and related information regardless of whether a property listing has been withdrawn or expired.
We may collect and analyze engagement metrics related to property listings, including but not limited to, views, interactions, and other User activity. These metrics are gathered to improve the functionality and User experience of the Sites and Services and may also be used to provide insights to real estate professionals. While we strive to ensure the accuracy and usefulness of these metrics, it does not guarantee their precision or completeness. We disclaim any and all liability for any User reliance placed on these metrics or for any decisions made based on them. Users should independently assess and verify property information and make decisions based on their own research and judgment.
4. TERMS FOR REAL ESTATE PROFESSIONALS 
As a real estate professional, you may create a profile (the &ldquo;Profile&rdquo;) associated with your Account.&nbsp; You grant us permission to display on our Sites and elsewhere information that we gather or that you have provided on your Profile related to any of the real estate transactions that you have handled as a real estate professional to help your potential clients better understand your areas of expertise. Any information you provide us on your Account, Profile, and otherwise must be accurate, complete, and owned by you, and you agree to update it if it becomes incorrect. If we find any inaccuracies, we may correct them ourselves. You also grant us permission to e-mail or display your Profile including your name, likeness, contact details, and transaction information and such other information as may be supplied by you on our Sites. Your Profile may be shared with potential clients across the United States, so be sure you are comfortable with the information you are sharing on your Profile.
When you create a Profile as a real estate professional on the Sites, or if you create a Profile on behalf of a real estate professional on the Sites, you represent and warrant that you have the authority to bind the real estate professional to these Terms. As a real estate professional, your Profile should be used for work purposes only. AgentMatch assumes no responsibility whatsoever and disclaims all liability for any of your content on your Profile or any of the information that you otherwise share with any potential clients.
As a real estate professional using our Site, you may receive or have access to certain information, including contact and other personal information, provided by clients and/or potential client. Each real estate professional should maintain the confidentiality of user information and safeguard it with at least the same level of care as they use to protect their own sensitive information, and in no case less than the industry standard of confidentiality required of them under applicable law.&nbsp;
You are solely responsible for keeping your real estate license current and adhering to all relevant real estate regulations concerning disclosures, documentation, and other brokerage obligations. Furthermore, you are solely responsible for the real estate brokerage services you offer to your clients and potential clients. You also agree to indemnify, defend, and hold AgentMatch.AI harmless against any claims, expenses, or damages that we might incur from claims by your clients and/or potential clients, related to the real estate brokerage services you have provided.
If you use our Sites to create a property listing, you are solely responsible for all information provided on such property listing, as well as keeping the information up to date. If you provide any information that is untrue, inaccurate, not current, incomplete, or misleading, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, incomplete, or misleading, we reserve the right to immediately remove your property listing from the Sites. We assume no responsibility and disclaim all liability for any of the information you provide on a property listing and we do not guarantee its legality. You are solely responsible for following all applicable laws.
AgentMatch cannot, does not, and will not provide any financial, real estate, or related advise of any kind whatsoever, and it shall not be liable, answerable or accountable, in any way whatsoever, for any loss or damage resulting from the advice given by a real estate professional including but not limited to any exercise or refusal to exercise a discretion, any mistake, error of judgement, or any act or omission.
5. REFERRAL AGREEMENTS
AgentMatch may enter into a referral agreement from time to time with a real estate professional for certain types of real estate transactions. The real estate professional confirms that they are fully authorized to enter into a referral agreement and are doing so voluntarily, without any external pressure or additional incentives from AgentMatch. The real estate professional assures that their performance and obligations under any referral agreement will not breach or infringe upon the rights of any third party, nor violate any other agreements with any individual, organization, or business, or any applicable laws or regulations. The real estate professional also confirms that they are properly licensed to conduct real estate transactions within the relevant jurisdiction and territory for any of the referrals they accept.
6. TERMS FOR BUYERS AND SELLERS
While using our Sites, you may create a Profile and you are solely responsible for keeping your Profile accurate and updated. We will not be liable under any circumstances whatsoever for any mistakes you make when creating and uploading your Profile. Your Profile may be shared with real estate professionals across the United States, so be sure you are comfortable with the information you are sharing on your Profile. We assume no responsibility and disclaims all liability for your Profile, any of your information contained therein,&nbsp;or otherwise that you share with real estate professional.
Creating a Profile or otherwise sharing your information with real estate professionals may result in your Profile being copied and published. We do not have control over any real estate professional&rsquo;s use or disclosure of your Profile, or any information contained therein. In the event of such real estate professional&rsquo;s disclosure, we do not have control of any third-party&rsquo;s potential further use or disclosure of your Profile, or any information contained therein.
You may choose to include your contact information on your Profile, such as your telephone number, e-mail, mail address, or other reasonable modes of communication. By providing this information on your Profile, you consent to being contacted by a real estate professional through one of these modes of communication.
While AgentMatch can provide profiles of suggested agents, you understand, acknowledge, and agree that you are responsible for choosing which real estate professionals to connect with. You understand that matching, or otherwise connecting, with a real estate professional through our Sites does not guarantee the successful acquisition of any property. While our Sites aims to connect you with qualified and reputable real estate professionals throughout the United States, we cannot and do not guarantee the quality of service provided by any real estate professional, their ability to meet your expectations, the availability of any property you seek, that you will secure the property, or that he real estate professional you match with will be able to meet all of your property-related needs.

Additionally, you understand that we may enter into a referral agreement with a real estate professional for certain types of real estate transactions in exchange for a referral fee, which may be a fixed fee or a percentage of the commission earned by the real estate professional(s) involved in the transaction. Any such fee is paid by the real estate professional(s) and does not incur any cost to you. During the term of the referral agreement, AgentMatch may share with the real estate professional(s) in accordance with our Privacy Policy at www.agentmatch.ai. This sharing is essential for the real estate professional(s) to effectively serve their potential client. The real estate professional shall maintain the confidentiality of this information and will safeguard it with at least the same level of care as they use to protect their own sensitive information, and in no case less than the industry standard of care. Further, you understand that, although we may introduce you to third-party real estate professionals, this introduction does not imply that we now act as your agent or represent you in any capacity. We do not provide real estate brokerage services and only make introductions to matching real estate professionals. Your use of our Sites or Services confirms your understanding and acceptance of this referral fee arrangement.
7. AI Feature
Our Sites and Services have artificial intelligence features (&ldquo;AI Features&rdquo;). You may provide input to our Sites or Services (the &ldquo;Input&rdquo;), for example though a chatbox, and receive output from our Sites or Services based on the Input (the &ldquo;Output&rdquo;). This Output is generated by AI tools. Input and Output are collectively &ldquo;Content.&rdquo; You are solely responsible for your Content, including ensuring that it does not violate any applicable law or these Terms. Due to the nature of the AI Features, Output may not be unique or incorrect, and the AI may generate the same or similar output for you or other Users. We do not guarantee the accuracy of any Output generated by the AI Features. Agent Match hereby grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable license to use the AI Feature. The use of the AI Feature is subject to your compliance with any and all applicable laws and these Terms. You understand and acknowledge that the AI Feature is not mandatory or integrated by default, our Sites, Services, your Account, your Profile, your Membership or Subscription may be used without enabling the AI Feature. The AI Feature is currently provided free of charge, however, we reserve the right to charge fees at any time upon providing prior written notice.

8. USE AND RESTRICTIONS 
Our Sites may be accessed only by individuals who are 13 years of age or older, and who are not barred from using any of our Sites and/or Services under any applicable laws. If you use or engage with the Sites and/or Services and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent or legal guardian&rsquo;s permission to do so. You may access and use any Sites and/or Services only in accordance with all applicable laws and regulations and with these Terms of Use. You acknowledge and agree that AgentMatch, in its sole discretion and without notice or any further obligation to you, may temporarily suspend or permanently discontinue and refuse any and all current and future access to or use of any of our Sites, Services and/or Account or Membership or Subscription. Creating an Account and/or a Profile and using the Membership or Subscription may only be done by individuals 18 and older who can legally enter into binding agreements. You acknowledge and agree that upon termination of your Account, Profile, Membership, and/or Subscription by AgentMatch, you may lose any and all information recorded with the aforementioned.
Although AgentMatch and its Sites and Services are based in the United States, regardless of where you view, access, or use any Services, any information collected as part of that access or use will be transferred to and maintained on servers located in the United States, or in any other place where AgentMatch or its employees or independent contractors are located.&nbsp; Any information we obtain about you will be stored in accordance with United States privacy laws, regulations, and standards, which may not be equivalent to the laws in your country of residence or the location where you are viewing, accessing, or using any of our Sites, Services, Account, Profile, Membership and/or Subscription. By accessing and/or using any Sites, Services, Account, Profile, Membership and/or Subscription, you consent to the capture, collection, transfer, transmission, storage, processing, and use of your information in and to the United States.
9. PROHIBITED CONDUCT
By using any of our Sites or Services, you agree not to use any Sites or Services in any manner that does or constitutes any of the following:

<li class="li3">Copies, modifies, creates a derivative work of, reverse engineers, decompiles, or otherwise attempts to extract the source code of the software underlying any Sites, Services, Accounts, Profiles, Subscriptions, or Memberships, or any portion thereof.</li>

<li class="li3">Consists of any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation.</li>

<li class="li3">Is false, inaccurate, misleading, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, profane, sexually oriented, obscene, libelous, invasive of another&rsquo;s privacy, hateful, or racially, ethnically, or otherwise objectionable, as determined in our sole discretion.</li>

10. USER CONTRIBUTIONS
The Sites may contain message boards, chat forums, chat rooms, bulletin boards, testimonials, or other interactive features that allows Users to post, view, like, follow, and share contributions on public areas of the Site (collectively, &ldquo;User Contributions&rdquo;), as well as send and receive direct messages from other Users (the &ldquo;Direct Communications&rdquo;).
You agree that any and all User Contributions and Direct Communications may be reviewed by AgentMatch and stored for analysis and to make the Sites and our Services better. This data may also be used to create statistical models and improve engagement metrics.
User Contributions and Direct Communications must comply with all applicable federal, state, and local regulations. Without limiting the foregoing, User Contributions must not:

<li class="li3">Contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, inaccurate, or otherwise objectionable.</li>

<li class="li3">Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, age, or any other protected class.</li>

<li class="li3">Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other proprietary rights of any other person or entity.</li>
</ol>

<li class="li3">Violate the legal rights (including the rights of publicity and privacy) of others.</li>

<li class="li3">Contain any material that could give rise to criminal or civil liability under applicable laws or regulations, domestic and international, or that otherwise may conflict with these Terms of Use, our Privacy Policy, or any Company Policies.</li>

<li class="li3">Be likely to deceive.</li>
</ol>

<li class="li3">Promote any illegal activity, or advocate, promote, or assist in any unlawful act.</li>

<li class="li3">Be likely to cause annoyance, inconvenience, duress, distress, discomfort, or needless anxiety or be likely to upset, embarrass, alarm, or annoy any other person.</li>

<li class="li3">Impersonate any person or misrepresent your identity or affiliation with any person or organization.</li>
</ol>

<li class="li3">Involve commercial activities or sales, such as contests, sweepstakes, and other promotions, bartering or advertising not approved in advance in writing by AgentMatch</li>
</ol>
&nbsp;
<ol class="ol1">
<li class="li3">Give the impression that they emanate from or are endorsed by AgentMatch or any other person or entity if this is not the case.</li>
</ol>
&nbsp;
<ol class="ol1">
<li class="li3">Result in the unauthorized disclosure of the personal information of any other person.</li>
</ol>
&nbsp;
<ol class="ol1">
<li class="li3">Constitute electioneering, such as exhortations to vote for or against any candidate for public office.</li>
</ol>
User Contributions and Direct Communications have not necessarily been reviewed or approved by AgentMatch and we, therefore, make no representations or warranties, now or in the future, as to the accuracy, reliability, completeness, or timeliness of any User Contributions and Direct Communications.&nbsp; Any views or opinions expressed through User Contributions and Direct Communications belong solely to the users who shared the contributions and messages and not to AgentMatch. Your provision of or reliance upon any User Contributions or Direct Communications is done entirely at your own risk. You understand and agree that AgentMatch is not responsible for, and shall have no liability related to, under no circumstances whatsoever any User Contributions or Direct Communications, including, without limitation, your provision thereof or reliance thereon. Further, under no circumstances whatsoever shall any User Contributions or Direct Communications be considered an endorsement of or by any of our Services. 11. MONITORING AND ENFORCEMENT
AgentMatch has the right to:

<li class="li3">Disclose your identity or other information about you to a third party who, in AgentMatch&rsquo;s sole discretion, reasonably claims that material posted by you violates such third party&rsquo;s rights, including, without limitation, his, her, or its intellectual property rights or privacy rights.</li>

<li class="li3">Take appropriate legal action, including, without limitation, referral to law enforcement, for any illegal or unauthorized use of any Sites, Services, Accounts, Profiles, Subscriptions, or Memberships.</li>

<li class="li3">Terminate or suspend your access to all or part of any Sites, Services, Accounts, Profiles, Subscriptions, or Memberships for any or no reason, in the sole discretion of AgentMatch.AI, including, without limitation, any violation of these Terms of Use, our Privacy Policy, or any Company Policies.</li>

<li class="li3">Fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through any Sites, Services, Accounts, Profiles, Subscriptions, or Memberships.</li>

<li class="li3">Remove or refuse to post any User Contribution and/or Direct Communication for any or no reason in the sole discretion of AgentMatch.</li>

<li class="li3">Take any action with respect to any User Contribution and/or Direct Communication that AgentMatch deems necessary or appropriate in the sole discretion of AgentMatch.</li>
</ol>
12. THIRD PARTIES/THIRD PARTY WEBSITES AND SERVICES
Our Sites or Services may provide links to third-party websites that are not owned or controlled by AgentMatch, (the &ldquo;Third-Party Websites&rdquo;). We provide such links solely as a convenience. We do not review, approve, endorse, or make any representations about Third-Party Websites, the companies or persons who own and/or operate them, or any information, content, software or other products and services made available through Third-Party Websites, or any results that may be obtained from using them. 16. CHOICE OF LAW; DISPUTE RESOLUTION; CLASS ACTION WAIVER

<li class="li3">Choice of Law. The validity, interpretation, and performance of this Agreement shall be controlled by and construed in accordance with the laws of the State of California without regards to its conflicts of laws principles.</li>

Except as prohibited by law, any dispute or controversy regarding the enforcement or interpretation of this Agreement will be resolved through binding arbitration under the Comprehensive Arbitration Rules and Procedures of JAMS or pursuant to the JAMS Streamlined Arbitration Rules and Procedures in Los Angeles County, California. THE PARTIES UNDERSTAND THAT BY AGREEING TO ARBITRATE DISPUTES THEY ARE WAIVING ANY RIGHT THEY MIGHT OTHERWISE HAVE TO A JURY TRIAL. This arbitration provision is not intended to modify or limit the right of AgentMatch to seek equitable relief, such as an injunction or attachment, through judicial process, which will not be deemed a waiver of the right to demand and obtain arbitration. EACH PARTY HEREBY CONSENTS TO THE EXCLUSIVE JURISDICTION OF ANY COURT OR JAMS TRIBUNAL IN LOS ANGELES COUNTY TO RESOLVE ANY DISPUTE OR CONTROVERSY ARISING FROM OR RELATING TO THIS AGREEMENT.</li>

<li class="li3">Class Action Waiver.&nbsp; Any arbitration under this Agreement will take place on an individual basis; class arbitrations and class actions are not permitted. Neither you nor AgentMatch has the right to act as a class representative or participate as a member of a class of claimants with respect to any claim.</li>

17. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless the AgentMatch Parties from and against any and all damages arising from, incurred as a result of, or in any manner related to or in connection with (a) your User Contributions, Direct Communications, or any other content posted by you; (b) your use of or connection to any Sites, Services, Account, Profile, Subscription or Membership (including any use by you on behalf of your employer, a family member, a friend, and any use by third parties under your Accounts or Profiles); (c) your use of any Services content; and/or (d) your violation of these Terms of Use, Privacy Policy, or any Company Policies. AgentMatch may participate in the defense of any such claim or action and any negotiations for its settlement or compromise. No settlement which may adversely affect AgentMatch&rsquo;s rights or obligations shall be made without our prior written approval. AgentMatch reserves the right to assume exclusive defense and control of any such claim or action.
18. MODIFICATION AND TERMINATION
AgentMatch reserves the right to modify these Terms of Use at any time, without notice, and in its sole discretion. When we do so, we will update the &ldquo;Last Updated On&rdquo; date above. By continuing to use any of our Sites, Services, Account, Profile, Subscription, or Membership, or any portion thereof, after we post any such changes, you accept these Terms of Use as modified.
AgentMatch reserves the right at any time, without notice, and in its sole discretion to modify, suspend, withdraw, or terminate the Terms, or any services provided through any Sites, Services, Account, Profile, Subscription, or Membership (or any part thereof), and/or your use of, or access to, any of the aforementioned, with or without notice.&nbsp; AgentMatch may also delete, restrict, or prohibit your access to, and/or use of, any Sites, Services, Accounts, Profiles, Subscriptions, or Membership, and any User Contributions or Direct Communications, in whole or in part, including, without limitation, if you are a registered user.&nbsp; AgentMatch will not be liable to you or any third party if, for any reason, all or any part of any Sites, Services, Account, Profile, Subscription, or Membership, or any User Contributions or Direct Communications, are unavailable at any time or for any period of time.&nbsp; AgentMatch will not be liable for any modification, suspension, withdrawal, or termination of the services or content provided through any Site, Services, Account, Profile, Subscription, or Membership, or for the loss of any related information.
19. MESSAGING SERVICES
AgentMatch may allow users to request and receive offers, newsletters, and other marketing and/or promotional campaigns via communications, including but not limited to text messaging and email. By providing us with your contact information, you are consenting to receive the above-mentioned communications from AgentMatch.&nbsp; You acknowledge that there may be some risk that the information in the communication(s) could be read by a third party. AgentMatch provides no warranty for any of the pricing data or other information provided to you via such communications. If you provide us with a third party&rsquo;s contact information in connection with a messaging service, you represent that you have permission for us to contact such third party. When you use the Sites, Services, Account, Profile, Subscription, or Membership, or send e-mails, messages, and other communications from your desktop, tablet, or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically. You agree that (a) all agreements and consents can be signed electronically and (b) all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such notices and other communications be in writing.
You agree that AgentMatch may contact you by telephone or text messages (including by an automatic telephone dialing system) at any of the phone numbers provided by you or on your behalf in connection with your Account or Membership or Subscription or otherwise provided to us by accessing or using our Sites or Services, including for marketing purposes. You agree that AgentMatch may leave a voicemail on any messaging service associated with any phone number provided by you or on your behalf in connection with your Account, Subscription, or Membership, or by accessing or using our Sites or Services, and that such voicemail may contain private information.&nbsp; If you provide us with a third party&rsquo;s contact information in connection with a messaging service, you represent that you have permission for us to contact such third party by telephone or text messages (including by an automatic telephone dialing system) at any of the phone numbers provided, including for marketing purposes. Should you send AgentMatch a direct SMS message through a mobile device, such message constitutes your prior express written consent to receive the messages you request to that SMS device. No modification to these Terms of Use will be binding on AgentMatch unless in writing and signed by an authorized AgentMatch representative or posted by AgentMatch to any Sites or Services. You may not assign, sublicense, delegate, or otherwise transfer these Terms of Use or any right granted hereunder.</li>

You waive any requirement for the posting of a bond or other security if AgentMatch seeks such an injunction.</li>

We use third-party payment processors like Stripe for processing credit card payments. Therefore, we do not retain personally identifiable financial information such as credit card numbers. All such information is provided directly to our third-party processor. <li class="li1">Inquiry and Communications Information: This includes information provided via email, chat bots, phone calls, or text messages, as well as contact information provided through our Services. We use this data to respond to your inquiries and communicate with you.</li>
<li class="li1">Marketing and Email Information: This encompasses your email address and communication preferences. We use this data to manage our communications and send information about products and services that may interest you. To stop receiving marketing emails, click the &ldquo;unsubscribe&rdquo; link at the bottom of the email. Note that certain service-related email communications (e.g., account verification, transaction confirmations, technical or legal notices) cannot be unsubscribed from.</li>
<li class="li1">Information Collected Through the Use of the Services: This includes any files, documents, videos, images, data, or information you upload or transmit through your interactions with us or other users, collectively referred to as &ldquo;User Content.&rdquo; User Content and any information contained within it are stored and collected as part of the Services. By submitting feedback, you grant AgentMatch the right to post and publish it at our discretion. With your consent, we may also share your testimonial along with your name.</li>

We also obtain personal information from third parties, which we often combine with personal information we collect either automatically or directly from individuals.

Your information, including personal information, is processed at AgentMatch&rsquo;s operating offices and in any other places where AgentMatch or its employees or independent contractors are located, except as may be otherwise processed by relevant third-party platforms and the companies that operate them. This means that your information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

AgentHire is committed to protecting the online privacy of children and making the internet safe. Our services are not intended for children under the age of 16. We do not knowingly solicit or collect personal information from children under the age of 16. If we learn that any personal information has been collected inadvertently from a child under 16, we will not keep that information. 11. CALIFORNIA DO NOT TRACK NOTICE DISCLOSURES
We do not track our Users and visitors over time and across third-party platforms to provide targeted advertising. Consequently, we do not respond to Do Not Track (DNT) signals. Other third-party platforms may keep track of your browsing activities when they provide you with content, which enables them to customize what they present to you on their platforms.

California residents have the right to equal service by us, and we will not discriminate against any California residents if they exercise their rights under the CCPA.
Disclosure of Incentives: If businesses offer any financial incentives for the collection, sale or deletion of California residents&rsquo; Personal Information, residents have the right to be notified of any financial incentives offers and their material terms, the right not be included in such offers without prior informed opt-in consent, and the right to be able to opt-out of such offers at any time. Businesses may not offer unjust, unreasonable, coercive, or usurious financial incentives. We do not offer any financial incentives at this time.

You do not need to create an account with us to exercise your Right to Opt Out. However, we may ask you to provide additional personal information so that we can properly identify you in our dataset and to track compliance with your opt out request. We will only use personal information provided in an opt out request to review and comply with the request. If you chose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems.

14. Data Retention
We retain personal information while an individual uses our Services according to this Privacy Policy. If an individual stops using our Services, we will keep their personal information as necessary to meet our legal obligations, resolve disputes, defend claims, and for any other purposes based on their choices, such as receiving marketing communications. Specifically, we retain records of conversations, personal information provided when joining our services, complaints, and other details from the duration of the individual&rsquo;s contract until statutory limitation periods expire if needed for legal claims.
We keep personal information only for as long as needed to achieve the purpose for which it was collected. However, if required by legal, tax, or accounting regulations set by authorities, we may retain it for longer periods until the relevant retention periods or deadlines have passed.
